Providing our clients with high-quality, effective, and efficient legal services Many individuals believe Trust Administration under California law is much simpler than a traditional court-monitored Probate Administration. In some regards this is true, but generally Trust Administration is just as time consuming and complex as a traditional Probate Administration. The Trustee in a Trust Administration must act much like the Executor in a Probate Administration by finding all of the decedent’s assets, paying off all creditors' claims of the decedent, and then distributing those assets to the rightful beneficiaries of the Trust. Additionally, in many cases individual tax returns, a Trust tax return, and an Estate tax return are required to be filed with the Internal Revenue Service and the Franchise Tax Board when administering a decedent’s estate. Simply put – Trust Administration is just like a Probate Administration, but without extensive Court supervision. Thus, individuals need to seek qualified counsel when doing any type of Trust Administration.
