Trustee: The Worst Job in the World?

Do you want to be a trustee of your parent's trust? Stewart Albertson shares his advice.

[Music] Hi this is Stuart Albertson with Albertson and Davidson the question do you want to be a trustee of your parents trust and I can affirmative Lee strongly with a lot of convictions say no you do not want to be the trustee many people think that being the trustee is a favorite position it's a position that you'll enjoy and that you'll work with your siblings and they'll work with you and everything buddy's gonna be happy and sing Kumbaya that's generally not how it works most trust beneficiaries look at trustees as an impediment to their rightful inheritance and they'll be constantly asking the trustee when am I gonna get my money when am I gonna get my money when am I gonna get my distribution so being a trustee that's one of the aggravations the other aggravations of being a trustee is that you're gonna have a lot of duties imposed on you by the state of California the state of California knows that you don't care about other people's assets including your parents after they're gone as much as you care about your own and so what the law says is we're gonna impose duties on you to make sure that you do care about the assets that are part of the trust that you're protecting administrating making productive for beneficiaries who one day are gonna receive those assets so being a trustee is essentially a thankless job there's lots of rules that are put on you that you must follow and by the way those rules which we call trust duties those duties are a one-way street many people many trustees feel offended when beneficiaries treat them rudely as trustees and they point to this as bad behavior on the part of the beneficiaries and while that might be bad behavior and maybe it's not nice or maybe it's rude it's not pleasant there's no duties that beneficiaries Oh to trustees so ultimately being a trustee for the most part is a thankless job you do get compensated for it not well enough for the the hardships you have to go through and ultimately you probably don't want to be a trustee Albertson and Davidson is here to help you fight for your inheritance check out Alda law calm for our complete library of helpful legal videos and articles from your favorite California trusts and we'll litigation law firm Albertson and Davidson LLP.
