Beneficiary Lawyer

While the trustee's attorney does represent the trust, this does not mean that they are looking out for your best interest as a trust beneficiary. Attorney Stewart Albertson explains when the beneficiary will need their own lawyer.

[Music] So once again you find out you're a beneficiary of a three million dollar trust there are three beneficiaries you're supposed to get a million dollars at the end of this it's a very happy exciting day for you you call the trustees attorney who is the attorney for the trust for the trustee and you say to the trustees attorney hey I got some questions for you and the trustees attorney said happy to help fire away I'll answer all your questions sure enough you ask your 10 questions that attorney answers all of them you feel good as a beneficiary because you believe this is the Trust's quote-unquote attorney they're required to look after your interests true false the trustees attorney while they do represent the trust the trustee and the trust they represent the trustee and the trustees interest in the trust as the officer of that trust they don't represent the trust beneficiaries now they should be willing to give some preliminary information to the trust beneficiaries but they don't represent the beneficiaries so if there are questionable things happening in your trust that you're the beneficiary of you're not getting information you're not getting distributions the trustee is refusing to communicate with you you're you as the beneficiary you're gonna have to have your own lawyer who will then call the trust lawyer to figure out what's going on chances are they'll hopefully be able to iron all that out and get you your rightful distributions sooner than fight Albertson and Davidson is here to help you fight for your inheritance check out al dev law comm for our complete library of helpful legal videos and articles from your favorite California trusts and we'll litigation law firm Albertson and Davidson LLP.
