Beneficiary Qualifications

It really does not take much to qualify as a beneficiary and receive your inheritance if you have been named as one under a will or trust. Attorney Keith Davidson explains when there may be a few caveats to receiving your assets as a beneficiary.

[Music] So what does it take to qualify as a beneficiary if you've been named as a beneficiary in a trust or will and you're supposed to receive a gift out of that trust or will it really doesn't take much to qualify to be a beneficiary once you're named as a beneficiary you'll receive your money unless you're a minor meaning you're under 18 or you have a disability that makes it impossible for you to be able to manage your own financial affairs if you're a minor under age to age 18 you can't own assets directly you have to wait until you're an adult and in that case either the trust will specify that your trust share is held for you until you become an adult most trusts say that or if that's not the case then you would have to get a guardian appointed and the assets can be distributed to your guardian or the trustee has the option of using something like a transfer a uniform transfer to minors account and the uniform transfer to minors account is a basic bank account you can set it up at any bank and once the money's there it'll stay there until a minor reaches age 18 so those are some ways in which to get assets out to a minor who can't own assets directly the same generally is true for a disabled person if a disabled person is under conservatorship then the assets can pass through the conservatorship rather than passing to the disabled person directly but that would require somebody to actually have a conservatorship in place and if somebody's supposed to get trust assets and they can't manage their own financial affairs then you really need to go to court and have a conservatorship set up for that beneficiary so that their assets can pass out to their conservatory Albertson and Davidson is here to help you fight for your inheritance check out Alda law calm for our complete library of helpful legal videos and articles from your favorite California trusts and we'll litigation law firm Albertson and Davidson LLP.
