Dividing Non-Financial Assets
Attorney Keith Davidson talks about how to allocate assets among the trust beneficiaries.

[Music] Hi this Keith Davidson from Albertson and Davidson in this video I'm talking about how do you allocate assets among the trust beneficiaries so you may have a trust that says that all of the beneficiaries are to receive an equal share of the trust estate but you may not have equal assets so for example let's say you have to trust beneficiaries who are each supposed to get an equal portion of the estate and the trust owns two houses but the houses are different values one is worth a million the other one's worth half a million how do you allocate those houses to the beneficiary obviously if you gave one beneficiary the house for a million and another beneficiary the house for half a million is not going to be equal so that's going to be a problem of course if the beneficiaries agree to that allocation then you can do it but most beneficiaries will not agree to that unequal allocation and rightfully so so then you have a few decisions that have to be made you could sell both of the properties take the cash and distribute the cash equally or you could distribute the properties but have the beneficiaries who is receiving the more expensive property take out a mortgage loan to pay money to the other beneficiary to make them equal there's a number of different ways in which you can equalize these distributions but you have to put some thought into it and think about how are we going to allocate the assets among the beneficiaries the same is true of just about any other assets so jewelry cars stocks and bonds you always have to consider how are we going to spread this among the beneficiaries in a way that is equal of course selling the assets and distributing the cash is always an option but it may not be the best option for the beneficiaries so you may want to consider other alternatives Albertson and Davidson is here to help you fight for your inheritance check out Alda law comm for our complete library of helpful legal videos and articles from your favorite California trusts and we'll litigation law firm Albertson and Davidson LLP.
