The Have’s and the Have Not’s: Trust Uses and Abuses Series
Every beneficiary or heir-at-law who has a problem with a Trust falls into one of two broad categories: Have's and Have Not's. Have's are the people who are named in a Trust to receive some sort of gift or a share of the remaining Trust assets, but for some reason they cannot get their gift or share. Have not's are people who have been excluded from the document altogether, which we refer to as disinherited. Both groups of people are not getting what they deserve. In this series, we are discussing some of the ways in which Have's and Have Not's can identify the problem they have and what some of the solutions are to restore your rightful inheritance.
